ELECTRONIC ACKNOWLEDGMENT AND ACCEPTANCE By checking the acceptance box, you formally execute this Agreement and acknowledge that you have read, understood, and voluntarily agree to be bound by these Terms & Conditions. You confirm your understanding that this is a pre-launch evaluation application form, that selection is at the sole discretion of SafeOwl, Inc., that product specifications and timelines are subject to change, and that SafeOwl and its corporate Affiliates maintain a license to utilize submitted privacy data, feedback, media, and reviews in accordance with these Terms, subject to the governing jurisdiction of the State of Texas and the United States.
Applications are reviewed on a rolling basis. Spots fill fast.

THESE TERMS AND CONDITIONS (“TERMS” OR “AGREEMENT”) GOVERN YOUR APPLICATION FOR, AND PARTICIPATION IN, THE SAFEOWL FIRST 100 FOUNDING FAMILIES PROGRAM (“PROGRAM”). BY SUBMITTING AN APPLICATION OR PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT PARTICIPATE IN THE PROGRAM.
1. Program Overview and Objectives. The First 100 Founding Families Program is an exclusive, pre-launch, invitation-only initiative designed to grant selected eligible participants early access to the SafeOwl OWLY 1 smartwatch and related hardware (collectively, the “Device”) and its related proprietary software services (this software along with the “Device” shall be referred to as Device and Software) prior to its general commercial public release. The primary objective of this Program is to facilitate real-world device testing, acquire qualitative participant feedback, and optimize ongoing product development based on authentic user experiences.
2. Participant Eligibility Requirements & Selection Process. This submission form constitutes your formal application for consideration into the Program, and the submission of this form does not guarantee acceptance, admission, or participation. To be considered for selection and to maintain active eligibility throughout the duration of the Program, applicants must satisfy all of the following criteria, namely that the applicant must: (a) be at least eighteen (18) years of age or older at the time of application; (b) be the legal parent or lawful guardian of the minor child who will be designated as the primary user of the Device; (c) maintain a primary residence within the United States; (d) fully execute the application process; and (e) be formally selected for admission by SafeOwl, Inc. (hereinafter referred to as “SafeOwl”) and execute consent to these Terms. SafeOwl retains sole, absolute, and unreviewable discretion regarding the review of submissions and the selection of shortlisted participants. Shortlisted participants who are successfully selected for the Program will be formally notified by SafeOwl via the contact information provided in their submission. Applicants who do not receive a formal notification of selection within SafeOwl's evaluation timeline shall be considered not shortlisted, and SafeOwl is under no legal obligation to provide individual rejection notices or feedback regarding unselected applications.
3. Provision of Program Benefits. Subject to strict compliance with these Terms, selected participants may be granted access to certain promotional Program incentives, which may include early access to the pre-release SafeOwl OWLY 1 smartwatch, priority user onboarding, dedicated customer support channels, exclusive, non-public Founding Family promotional structures and pricing, direct opportunities to collaborate on and influence future features and product development, and special ceremonial recognition as an inaugural "Founding Family" member. All such benefits are promotional, non-transferable, vary by individual participant, and are subject to modification, reduction, or cancellation by SafeOwl at any time without prior notice or liability.
4. Participant Obligations and Responsibilities. As an active participant in the Program, you expressly agree to perform the following duties during the evaluation period: (a) maintain active and consistent usage of the Device; (b) provide comprehensive, honest, and constructive feedback regarding Device performance; (c) promptly participate in scheduled surveys, interviews, product evaluations, and formal beta testing activities upon request by SafeOwl; (d) document and report technical glitches, software bugs, or functional anomalies through SafeOwl's designated technical channels; and (e) utilize the Device responsibly and in strict compliance with all applicable local, state, and federal laws. Participation in this Program is entirely voluntary, and you reserve the right to discontinue your participation at any time.
5. Intellectual Property and Content License. By participating in the Program and submitting data, media, or commentary, you hereby grant to SafeOwl a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable license to utilize any and all written reviews, testimonials, survey responses, photographs, video recordings, social media content, and general feedback submitted in connection with the Program. SafeOwl is authorized to use such materials for marketing, advertising, public relations, commercial promotions, and product development purposes, including the right to edit or format submissions for clarity provided the original intent is preserved. You acknowledge that no monetary compensation, royalties, or residuals shall be provided for such use unless expressly agreed upon in a separate writing signed by SafeOwl. You acknowledge that valid consideration for the license has been provided via participating in the Program.
6. Pre-Release Product Status Acknowledgment. You explicitly acknowledge and agree that the OWLY 1 smartwatch contains pre-release software, firmware, and features, and that product features, technical specifications, final commercial pricing, and overall functionality may change significantly prior to general commercial availability. SafeOwl reserves the right to modify, delay, or entirely remove any announced features or services at its sole discretion without liability, and you accept that the performance, stability, and reliability of the pre-release Device may vary materially from the final commercial retail version.
7. Data Privacy and Collection Disclosure. By completing and submitting this application form, you expressly acknowledge and agree that any and all privacy information, personal data, and contact information you submit may be accessed, processed, transferred, and utilized by SafeOwl, Inc., its subsidiary companies, parent entities, sister companies, joint ventures, and any of its current or future corporate affiliates (collectively, "Affiliates") for the purposes of managing the application process, administering the Program, and conducting internal corporate business operations. Furthermore, during active participation, SafeOwl and its Affiliates shall collect, monitor, and process data resulting from your use, including but not limited to device usage metrics, application interactions, feature engagement analytics, and technical performance logs. All data collection and processing shall be governed by, and handled in strict accordance with, the official SafeOwl Privacy Policy, and SafeOwl covenants that it will never sell, trade, or rent your personally identifiable information to unrelated, unassociated third parties outside of SafeOwl, Inc. and its corporate Affiliates. If you subsequently issue a verified request under applicable law to remove your personally identifiable information from SafeOwl's public-facing website and primary operational systems, SafeOwl will remove or anonymize such data within a commercially reasonable timeframe and in compliance with statutory limitations following receipt of such verified request; provided, however, that you acknowledge and agree that SafeOwl and its Affiliates retain the right to maintain back-up, archived, or legacy copies of such information as necessary to satisfy legal obligations, resolve ongoing disputes, prevent fraudulent activity, enforce this Agreement, or as otherwise permitted by applicable laws.
8. Safety, Liability Disclaimer, and Supervision Warning. The SafeOwl OWLY 1 is a supplemental communication and safety tool and is explicitly not a substitute for active parental or guardian supervision. You acknowledge that location tracking data may occasionally be unavailable, latent, or inaccurate due to variations in cellular connectivity, network bandwidth, and GPS satellite coverage across different geographic regions and environmental conditions, and that emergency services functionality may differ by regional jurisdiction. No wearable device can prevent emergencies or guarantee a child's safety, and parents or legal guardians retain primary, sole, and absolute legal responsibility for the supervision, safety, and well-being of their children.
9. Reservation of Rights and Program Modifications. SafeOwl reserves the right, at its sole discretion and without prior liability, to modify, suspend, or terminate the Program, in whole or in part, at any time. This reservation includes the right to alter, amend, or revoke Program benefits, requirements, or selection criteria, to limit overall participant volume, or to immediately remove any participant who violates these Terms.
10. Limitation of Liability. To the fullest extent permitted by applicable law, in no event shall SafeOwl, its Affiliates, officers, employees, partners, or authorized representatives be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of data, loss of use, or other intangible losses—arising out of or in connection with your participation in the Program, the application process, or use of the pre-release Device. Participation in this evaluation program is undertaken solely at your own discretion and risk.
11. Governing Law and Jurisdiction. These Terms, this Agreement, and any dispute, claim, or cause of action arising out of or related to the Program or the use of the Device shall be governed by, construed, and enforced in accordance with the laws of the State of Texas and applicable federal laws of the United States, without giving effect to any principles of conflicts of law. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Claims shall be heard by three arbitrators.
Method of Arbitrator Selection: Within 15 days after the commencement of arbitration, each party shall select one person to act as arbitrator and the two selected shall select a third arbitrator within ten days of their appointment. If the arbitrators selected by the parties are unable or fail to agree upon the third arbitrator, the third arbitrator shall be selected by the American Arbitration Association.
Locale Provisions: The place of arbitration shall be Dallas, Texas.
Information Exchange: Consistent with the expedited nature of arbitration, pre-hearing information exchange shall be limited to the reasonable production of relevant non-privileged documents explicitly referred to by a party for the purpose of supporting relevant facts presented in its' case, carried out expeditiously.
Duration of Arbitration Proceedings: The award shall be made within 18 months of the filing of the notice of intention to arbitrate (demand), and the arbitrator(s) shall agree to comply with this schedule before accepting appointment. However, this time limit may be extended by the arbitrator for good cause shown, or by mutual agreement of the parties.
Assessment of Forum Fees and Attorneys’ Fees: The prevailing party shall be entitled to an award of reasonable attorney fees.
Confidentiality: Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties.
Non-Payment of Arbitration Expenses: The parties agree that failure or refusal of a party to pay its required share of the deposits for arbitrator compensation or administrative charges shall constitute a waiver by that party to present evidence or cross-examine witness. In such event, the other party shall be required to present evidence and legal argument as the arbitrator(s) may require for the making of an award. Such waiver shall not allow for a default judgment against the non-paying party in the absence of evidence presented as provided for above.
Appeal: Notwithstanding any language to the contrary in the contract documents, the parties hereby agree: that the Underlying Award may be appealed pursuant to the AAA's Optional Appellate Arbitration Rules ('Appellate Rules'); that the Underlying Award rendered by the arbitrator(s) shall, at a minimum, be a reasoned award; and that the Underlying Award shall not be considered final until after the time for filing the notice of appeal pursuant to the Appellate Rules has expired. Appeals must be initiated within thirty (30) days of receipt of an Underlying Award, as defined by Rule A-3 of the Appellate Rules, by filing a Notice of Appeal with any AAA office. Following the appeal process the decision rendered by the appeal tribunal may be entered in any court having jurisdiction thereof.

No. Social sharing is optional, and only selected families are asked. What we require is a short written review and one simple video submitted privately to our team. Nothing public unless you opt in.
Only with explicit, signed consent from both parents or legal guardians. You decide what's comfortable. Many families choose first-names-only and no close-up faces. Others opt in fully. We never publish anything involving a child without written permission covering that specific use.
That's the whole point. We need honest feedback, including what's not working. Founding Families have a private feedback channel directly to our product team. Critical feedback helps us build a better product before public launch.
No. The OWLY 1 is a safety device. No social media. No internet. No games. No open app store. It's a watch that calls trusted contacts, tracks location for parents, and triggers an SOS when needed. School Mode activates automatically while GPS and SOS stay on silently in the background.
